When this case was called for hearing, no one appeared for the appellant. Solicitor General Jimmie S. Geizue appeared for the appellee and gave notice of the abandonment of further prosecution of this case. It is, therefore adjudged that the notice of abandonment should be and the same is hereby granted, the case stricken from the docket, and the appellant is ordered discharged without day.
The Clerk of this Court is hereby ordered to send a mandate to the trial court to this effect. And it is so hereby ordered
