JUDGMENT WITHOUT OPINION. Decided June 11, 1970.* No appearance for parties. When this cause was called for hearing, no one appeared for either party. At this stage, the Clerk informed the Court that a motion to dismiss the appeal had been filed by counsel for the appellee, and by order of the Court said motion was read. Upon deliberation, it is hereby adjudged that the motion to dismiss appeal is denied ; and counsel for the appellee is hereby fined in the sum of $25.00 for his failure to appear at the call of the case, said fine to be collected by the Marshal of this Court and deposited into the Bureau of Internal Revenues and an official receipt obtained therefore, cost against appellee. And it is hereby so ordered. * The Chief Justice and Mr. Justice Mitchell did not sit in the case. 146
