JUDGMENT WITHOUT OPINION

Decided: February 28, 2005.

At the call of this case, Counsellors M. Kron Yangbe and J. Emmanuel Wureh appeared for the plaintiff-in-error and Counsellor N. Oswald Tweh of the Pierre, Tweh & Associates appeared for defendants-in-error. Counsel for plaintiff-in- error informed the Court that his client had filed a submission to withdraw its case, to which there was no resistance made by the defendants-in-error.

After carefully considering said submission, the facts of the matter and the law controlling in this case, it is hereby adjudged that the submission to withdraw the petition be and same is hereby granted. The Clerk of this Court is hereby ordered to send a mandate to the court below ordering the judge presiding therein to resume jurisdiction over the case and enforce its judgment. And it is hereby so ordered.

NOTE: Mr. Chief Justice Cooper, having before been a member of the Law Firm which represented one of the parties, recused himself. Hence, he did not sign this judgment.
