JUDGMENT WITHOUT OPINION. Decided June 27, 1975. Patrick Sayenneh for appellant. Toye C. Barnard for appellee. M. K. Yangbe and When this case was called for hearing, Counsellor Patrick Sayenneh appeared for the appellant, Counsellors M. K. Yangbe and Toye C. Barnard appeared for the appellee and filed a motion to dismiss the appeal on the ground that the appeal bond and notice of completion of appeal were filed sixty – three days after rendition of judgment, contrary to the statute which requires that these jurisdictional steps be taken within sixty days. There was no resistance to the motion by appellant’s counsel. In view of the ground set forth in the motion and the failure of appellant’s counsel to resist, it is adjudged that the motion should be and the same is hereby granted and the appeal is dismissed with costs against the appellant. And the Clerk of this Court is ordered to send a mandate to the court below, commanding the judge therein to resume jurisdiction and enforce the judgment. And it is so ordered. 383
