JUDGMENT WITHOUT OPINION

When this case was called for hearing, Counsellor Roger C. H. Steele appeared for the appellant whilst Counsellor Clarence E. Harmon appeared for the appellee. Counsellor Harmon, for the appellee, then informed the Court that he had filed a motion to dismiss the appeal because of the appellant’s failure to file an appeal bond and to serve the notice of the completion of the appeal, and that he had attached supporting clerk certificates to the effect. Counsel for appellant conceded the legal soundness of said motion in that his client did not file an appeal bond as correctly stated. In view of the fact that the averments in the motion were not denied, it is hereby adjudged that the motion to dismiss the appeal should be, and same is hereby granted. The Clerk of this Court is hereby ordered to send a mandate to the court below to resume jurisdiction over the case and enforce its judgment. Costs against the appellant.

NOTE: Mr. Justice Boimah K. Morris, being absent when this case was called, did not participate; hence, he did not sign this judgment.
