JUDGMENT WITHOUT OPINION

When this case was called for hearing, the Bull Law Firm, represented by Counsellor Pearl Bull, appeared for the appellee/movant; no one appeared for the appellant/respondent. Counsel for appellee brought to the Court’s attention that appellee had filed a motion to dismiss the appellant’s appeal, a copy of which was served on appellant. Counsel also averred that even though a notice of assignment was served and returned served on both parties, counsel for appellant had failed and neglected to appear. Appellee therefore prayed for the granting of the motion. After having carefully studied the motion and the law controlling, it is hereby adjudged that the motion to dismiss the appeal is hereby granted with costs against the appellant.
The Clerk of this Court is hereby ordered to send a mandate to the court below, commanding the judge presiding therein to resume jurisdiction over the case and enforce its judgment. And it is hereby so ordered.
