JUDGMENT WITHOUT OPINION. Decided May 2, 1975. Nathan C. Ross for appellant. Moses K. Yangbe for appellee. Joseph F. Dennis and When this case was called for hearing, Counsellor Nathan C. Ross appeared for the appellant. Counsellors Joseph F. Dennis and Moses K. Yangbe appeared for the appellee and filed a motion to dismiss the appeal, on the ground that the appellant had neglected to take two of the steps necessary for an appeal ; namely, he had failed to file an appeal bond and to have issued and served a notice of completion of the appeal. After studying the motion, and in view of the appellant’s counsel conceding the correctness of the position taken by appellee’s counsel, it is adjudged that the motion to dismiss the appeal be and the same is hereby granted and the appeal is dismissed with costs against the appellant. And the Clerk of this Court is ordered to send a mandate to the court below informing it of this opinion and ordering it to resume jurisdiction and enforce the judgment herein. And it is so ordered. 369
