JUDGMENT WITHOUT OPINION. Decided April 26, 1973. Harper S. Bailey for appellant. pellee. M. M. Perry for ap- At the call of this case counsellor Harper S. Bailey appeared for the appellant, and counsellor M. M. Perry appeared for the appellee and filed a motion to dismiss the appeal, the grounds of which were conceded by appellant’s counsel. After considering the motion and the position taken by appellant’s counsel, it is adjudged that the motion to dismiss be and the same is hereby granted, and this case is dismissed with costs against the appellant. The Clerk of this Court is ordered to send a mandate to the court below, commanding it to resume jurisdiction and enforce its judgment. And it is so ordered. 257
