APPEAL FROM CONVICTION OF MURDER.

On appeal from conviction of murder, appellant and appellee presented stipulation to Court on effect of evidence adduced in lower court. Judgment reversed and remanded for new trial with directions.

This cause having been called for hearing, Counsellor William V. S. Tubman appeared for appellant, and the Honorable the Attorney General of Liberia appeared for appellee, when both parties filed a joint stipulation as follows:
“The appellant and the appellee agreeing in point of law and the evidence adduced at the trial of the above entitled cause that the crime murder has not been proven against appellant, but manslaughter; do hereby jointly apply to the court praying that the judgment of the lower court in said cause be reduced to manslaughter and such penalty as in the court’s mind is just and right according to law be imposed, taking into consideration the time the appellant has been imprisoned since the rendition of final judgment against him by the lower court.”
After a careful inspection of the record filed, and the law of the case, the Court has reached the conclusions which we now proceed to state as follows:
1.) That the verdict and judgment of the court below be and the same are hereby reversed, and the cause be remanded to the Circuit Court of the Fourth Judicial Circuit for a new trial.
2.) Upon the call of the case before said court, should appellant himself, upon arraignment, plead guilty of manslaughter as the stipulations of his counsel lead us to expect, the court will forthwith proceed to render the appropriate sentence, and may, in its discretion, take note of the period said appellant was held in actual detention, confinement and custody awaiting trial on the capital charge.
And the Clerk of this Court is hereby ordered to send a mandate to the court below as to the effect of this judgment. (Seal) Given under our hands and the seal of
