JUDGMENT WITHOUT OPINION. Decided June 12, 1970.* No appearance for parties. When this case was called for hearing, no one appeared for either party. In view of the foregoing and after due deliberation, it is hereby adjudged that this case having been docketed since 1966 and the parties in the case having been duly notified from time to time of the assignment of said cause, and having failed and neglected to appear for the prosecution of their cause although this case was duly assigned and bulletined for hearing, the case is, therefore, stricken from the docket of this Court with costs against appellant. Furthermore, counsel for the appellant is hereby fined the sum of $25.00 to be collected by the Marshal of this Court and deposited into the Bureau of Internal Revenues and an official receipt obtained therefor to be exhibited to the Court accordingly. And the Clerk of this Court is hereby ordered to send a mandate to the lower court informing it of this judgment. And it is so ordered. * The Chief Justice did not sit in the case. 147
