JUDGMENT WITHOUT OPINION

Decided November 23, 1984.

At the call of this case after due notice, Counsellor Clarence Harmon appeared for the appellee, but no one appeared tor the appellant. Whereupon counsel for appellee moved the court to dismiss the appeal because of appellant’s failure to appear and cited Rev. Code 1 :51.16 for reliance. After reading the records in the case and applying the law cited, it is hereby adjudged that the motion to dismiss the appeal be, and the same is hereby granted for failure of appellant to appear when the case was called for hearing. The Clerk of this Court is therefore instructed to send a mandate to the trial court commanding the judge presiding therein to resume jurisdiction and enforce its judgment. Costs are ruled against the appellant. And it is so ordered.
