Judgment without opinion.
This cause having been called for hearing, Counsellor H. Lafayette Harmon appeared for petitioner, and Counsellors N. H. Gibson and T. G. Collins appeared for respondents. After arguments pro and con it is hereby

 

ADJUDGED:
That inasmuch as at the time of the issuance of the writ of certiorari no evidence had been heard on either side, the case is hereby remanded for trial. The costs of these proceedings are disallowed, and the other costs are to abide the final determination of the case. The Clerk of this Court is hereby ordered to forthwith transmit to the court below a mandate as to the effect of this judgment.
