JUDGMENT WITHOUT OPINION

When this case was called for arguments, Counsellor J. Emmanuel Berry appeared for the appellant and Counsellor S. Benoni Dunbar, Sr., appeared for the appellee and informed the Court that he had filed a motion to dismiss appellant’s appeal. Counsel for the appellant spread on the minutes of court that he conceded the legal grounds for the motion and interposed no resistance thereto. After studying the motion and observing that the grounds for the motion are in keeping with law, it is hereby adjudged that the motion to dismiss be, and the same is hereby granted.
The Clerk of this Court is hereby ordered to send a mandate to the court below to resume jurisdiction and enforce its judgment with costs against the appellant. And it is so ordered.
