JUDGMENT WITHOUT OPINION DISMISSING APPEAL. Decided June 13, 1969.* No appearance for appellant. 0. Natty B. Davis for appellee. When this case was called for hearing, no one appeared for the appellant and counsellor G. Natty B. Davis appeared for the appellee. At this stage, counsel for the appellee made application that the Court, because of the absence of the appellant and counsel at the call of the case for hearing, invoke Rule IV, Part 6, of the Revised Rules of this Court and dismiss the appeal. After considering the said application, it is hereby ADJUDGED that this case having been regularly assigned and bulletined for hearing, and appellant having failed to appear, the application is granted and the case ordered dismissed. And the clerk of this Court is hereby instructed to send a mandate to the court below informing it of this judgment. And it is hereby so ordered. � The Chief Justice did not sit. 384
