REPUBLIC OF LIBERIA, Appellant, vs. JAMES JOHNSON, Appellee.

Appeal from the Court of Quarter Sessions and Common Pleas, Montserrado County.

Assault and Battery.

This case is before this court in obedience to a writ of certiorari issued by the Chief Justice for legal cause, in support of law and justice. The record of the proceedings in the court below discloses to this court evidence that there has been no trial of this case within the meaning of the law. Hence this court cannot see for whom judgment ought to be rendered. Therefore the case is remanded to the court from whence it comes, with directions that the said court resume jurisdiction over the case and parties, and try the same according to law and justice, recording all testimony, oral and written, offered at the trial. And further, that the trial of this case takes place at the next session of the court in which it was first entered, after notice of this order.
