When this case was called, counsellor J. Dossen Richards appeared for the appellant and counsellor Joseph Williamson, of the Mississippi law and accounting firm, appeared for the appellee. At this stage, counsel for appellant noted for the record that he conceded the legal correctness of appellee’s counsel, because when the appeal bond in this case was prepared by him and given to appellant to be signed by himself and sureties, appellant refused to sign said appeal bond, stating that he was afraid of bonds, and that is why no appeal bond was filed in this cause. After due consideration, it is hereby adjudged that there being no opposition to appellee’s motion to dismiss the appeal, the same is hereby granted, with costs against appellant. And the Clerk of this Court is hereby ordered to send a mandate to the lower court informing it of this judgment. � The Chief Justice did not sit. 393
