C. B. REEVES, Appellant, vs. J. A. PAYNE, Appellee.

[January Term, A. D. 1899.]

Appeal from the Court of Quarter Sessions and Common Pleas, Grand Bassa County.

Damages.

At the call of this case for trial, appellee failed to appear to defend the appeal as is required by law, whereupon the appellant motioned the court for judgment by default. This being a right growing out of law, therefore this court adjudges that the appellant is entitled to recover, and proceeds to the rendition of perfect or final judgment.

This court for lawful cause maketh void the judgment of the court below, and renders judgment that the appellant recover from the appellee the sum of twenty-five dollars as damages and all legal costs attending the suit; and the clerk of this court is hereby commanded to issue the proper mandate to the Court of Quarter Sessions, Grand Bassa County, to the effect of this judgment.
