JUDGMENT WITHOUT OPINION

 

At the call of this case, Counsellor Clarence E. Harmon appeared for the appellee and filed a motion to dismiss the appeal for failure of appellants to file an appeal bond. Counsellor S. Edward Carlor appeared for the appellants and conceded the legal soundness of appellee’s motion to dismiss appellants’ appeal, it is therefore adjudged.

 

That the motion to dismiss should be and the same is hereby granted and the appeal is hereby dismissed with costs against the appellants. The Clerk of this Court is ordered to send a mandate to the court below, commanding the judge presiding therein to resume jurisdiction over the case and enforce its judgment. And it is so ordered.

 

NOTE: Justice M. Kron Yangbe, being counsel for one of the parties prior to his elevation to the Bench, did not take part in the hearing and determination of this case; hence, he did not sign this judgment.

 

Justice Roosevelt S. T. Bortue participated in the deliberation and determination of this case but died before the final preparation. Hence, he did not sign this judgment.
