Counsel for Respondent/Appellant made a submission conceding the legal soundness of the Movant/Appellee’s Motion to Dismiss due to Respondent/Appellant’s failure to perfect the appeal.
Counsel for Movant/Appellee not having interposed any objection, it is hereby ADJUDGED:
That the Motion to Dismiss the appeal be and the same is hereby granted. The Clerk of this Court is ordered to send a mandate to the Judge presiding in the court below to resume jurisdiction over this case and give effect to this Judgment. Costs are ruled against the Respondent. It is so ordered.
