JUDGMENT WITHOUT OPINION

At the call of this case, Counsellor Arthur K. Williams appeared for the appellant and Counsellor S. Benoni Dunbar, Sr., appeared for the appellee and informed Court that he had filed a motion to dismiss the appeal for failure on the part of appellant to proceed and cited Civil Procedure Law, Rev. Code 1:51.16 as reliance. Agreeably, counsel for appellant having conceded the legal soundness of the motion, interposed no resistance. After studying the motion and the reliance, it is hereby adjudged that the appeal be, and the same is hereby dismissed.
The Clerk of this Court is hereby commanded to mandate the court below to resume jurisdiction and enforce its judgment. Appellant is ruled to pay all costs of this proceeding. And it is hereby so ordered.
