When this Case was called for hearing, Counsellor Theophilus C. Gould, Solicitor General of Liberia, appeared for Plaintiff/Appellee. Countsellor George S.B. Tulay,
who represented Defendant/Appellant, did not appear.
Counsel for Plaintiff/Appellee, Counsellor Theophilus C. Gould, Solicitor General of Liberia, requested this Court to make a submission which request was granted. In his submission, Appellee’s Counsel informed the Court that both Counsels had reviewed the case file, have resolved to file withdrawal of the appeal’ on the terms stated in the Notice of Withdrawal filed.
This Court having ascertained from the Parties, that their respective clients had fully acquiesced to the notice withdrawal of the Appeal, it is hereby ADJUDGED:
That the submission made to withdraw the Appeal is hereby granted and the appeal accordingly withdrawn. The Clerk of this Court is hereby ordered to send mandate to the Court below to resume jurisdiction and enforce its Judgment. COSTS Disallowed. IT IS HEREBY SO ORDERED.
