JUDGMENT WITHOUT OPINION. Decided June 8, 1973. No appearance for appellant. appellee. J. Dossen Richards for When this case was called no one appeared for the appellant; counsellor J. Dossen Richards appeared for the appellee and submitted for the record that because he found it difficult to support the judge’s ruling dismissing the case in passing on issues of law when there were only issues of fact to be tried and determined and also because the judge relied upon a rule of court which does not exist in the Debt Court, he joined the appellant in requesting the Court to remand the case to the Debt Court in Monrovia for proper disposition. After considering the submission, it is adjudged that the application of the appellee’s counsel should be and the same is hereby granted, and this case is remanded to the court below with instructions that the judge resume jurisdiction and proceed to hear and determine the case, costs to abide final determination. And it is so ordered. 269
