Findley and David A. T. Brown appeared for the appellant, and counsellor M. M. Perry appeared for the appellee. During the hearing counsel on both sides submitted to the Court that the several errors committed by the trial court could only be rectified by a remand of the case for the issues of law to be passed upon and a new trial. After reviewing the record, and in view of this position taken by the parties, it is adjudged that the judgment in the case be and the same is hereby reversed and the case remanded to the trial court, with instructions that the judge therein resume jurisdiction and proceed to pass upon the issues of law and hear and determine the case. Costs to abide the final determination. And it is so ordered. 255
