THE LIBERIA MINING COMPANY, LTD., Appellant, v. JOE TAMB A KROMAH, Appellee.

JUDGMENT WITHOUT OPINION. Decided June 18, 1976.* When this case was called, Counsellors D. Caesar Harris and M. Fahnbulleh Jones appeared for the appellant, and Counsellor Joseph J. F. Chesson appeared for the appellee and filed a motion to dismiss the appeal for the following legal reasons : ( ) that the affidavit of the sureties attached to the appeal bond failed to carry “a description of the property, sufficiently identified to establish the lien of the bond” as required by Rev. Code i :63.2 (3b). (2) that the bond was not accompanied by “a statement of the total amount of the liens, unpaid taxes, and other encumbrances against each property offered” as the law requires under Rev. Code i :63.2 (3c) . For these failures to conform to the sections cited above, appellee has moved to dismiss the appellant’s appeal. After studying the motion and the resistance, it is adjudged that the motion should be and the same is hereby granted, and the appeal is dismissed, with costs against the appellant. And the Clerk of this Court is ordered to send a mandate to the court below, commanding the judge therein to resume jurisdiction and enforce the judgment. And it is so ordered.
