THE MANAGEMENT OF THE LIBERIA ELECTRICITY CORPORATION, Appellant, v. SOLOMON LLOYD, Appellee.

JUDGMENT WITHOUT OPINION
Decided July 27, 1995.

 

When this case was called for hearing, Counsellor Winston O. Henries of the Henries Law Firm appeared for the appellee and Counsellor George S. B. Tulay of the Tulay & Tulay Law Associates, appeared for the appellant.

 

In arguing his motion to dismiss, the appellee contended that the appeal bond was defective because it was not filed in accordance with the statutory provisions, and that appellant failed to issue and serve a notice of completion of appeal on him. Therefore, he prayed that the appeal should be dismissed. Counsel for appellant having conceded the soundness of the motion and this Court having reviewed the appellee’s motion, and being convinced of its legal soundness, it is hereby adjudged that the appeal should be and that same is hereby dismissed. The Clerk of this Court is hereby ordered to send a mandate to the court below commanding the judge presiding therein to resume jurisdiction over this case and give effect to this judgment. Costs of these proceedings are ruled against appellant. And it is hereby so ordered.

 

NOTE: Mr. Justice E. Winfred Smallwood being on medical trip abroad, did not participate in the hearing of this case. Hence, he did not sign this judgment.
