THE LIBERIAN BANK FOR DEVELOPMENT & INVESTMENT (LBDI), Appellant, v. TOBERTA L. WEEKS and THE BOARD OF GENERAL APPEALS, Ministry of Labour, Appellees.

JUDGMENT WITHOUT OPINION

Decided: January 9, 1990.

At the call of this case, Counsellor Lawrence R. Johnson appeared for appellant and Counsellor Cyril Jones of the Jones & Jones Law Firm appeared for appellees. Counsel for both appellant and appellees brought to the attention of the Court that they have jointly filed a notice of withdrawal, relevant portion of which reads thus:

 

“…that the petitioner/appellant and the respondents/ appellees in the above entitled cause of action hereby withdraw all their claims and or defenses in the above mentioned summary proceedings.”

 

After carefully studying the said notice of withdrawal and applying the controlling law, it is hereby adjudged that the appeal which had given this Court jurisdiction over the case having been withdrawn said appeal is hereby ordered stricken from the docket of this Court. The Clerk of this Court is hereby ordered to send a mandate to the court below to give immediate effect to this judgment. Costs are ruled against appellant. And it is so ordered.

 

Note: Mr. Justice Kpomakpor, being ill when this case was heard, did not sit. Hence did not sign this judgment.
