JAMES S. KPADEH, Appellant, v. W. V. GULUMA, Appellee.

JUDGMENT WITHOUT OPINION. Decided June 18, 1976.* When this case was called, Counsellor George C. Watson appeared for the appellant, and Counsellor Bomia K. Morris appeared for the appellee and filed a motion to dismiss the appeal because of a defective appeal bond in that there is no affidavit of sureties attached to it as the law requires, and the notice of completion of appeal was served by the Sheriff 131 days beyond the 6o days after rendition of judgment, contrary to the law controlling appeals. After studying the motion and the resistance of the appellant’s counsel, it is adjudged that the motion to dismiss should be and the same is hereby granted and the appeal is dismissed with costs against the appellant. And the Clerk of this Court is ordered to send a mandate to the court below, commanding the judge therein to resume jurisdiction and enforce the judgment.
