At the call of this case, the Perry Law firm appeared for appellant and Counsellor Nete Sie Brownell appeared for the appellee, and gave notice that he had filed a motion to dismiss the appeal on the ground that from the filing of the bill of exceptions, no other step was taken to give this Court jurisdiction over the cause. No resistance to the motion was filed. It is therefore adjudged that the motion should and the same is hereby granted, and the appeal is dismissed with costs against the appellant. The Clerk of this Court is ordered to send a mandate to the lower court commanding the judge therein to resume jurisdiction over the case and enforce the judgment.
