The above-entitled cause was on appeal from the Chambers of Mr. Justice Barclay. When the case was bulletined for hearing and before this Court could review the records certified to it, the counsel for petitioners for the writ of prohibition filed in the office of the clerk of this Court a formal application for withdrawal of the petition dated November 26, 194.3, which stated the following:
“W. H. Ketter and L. J. Mills, purported sureties, petitioners in the above entitled cause, through their counsel H. Lafayette Harmon, Solicitor and Counsellor-at-law, most respectfully beg leave of this Honourable Court to formally WITHDRAW their petition, the entire case having been compromised and adjusted to the satisfaction of both parties concerned, and the case finally settled, the same being case No. 13 of the Trial Docket of this Court.

This Court, having carefully considered said application for withdrawal to which there have been no objections filed, hereby orders that the said petition for withdrawal be, and the same is, hereby granted, that the case be stricken from the docket of this Court, and that the court below resume jurisdiction and execute its judgment with costs against petitioners.
