JUDGMENT WITHOUT OPINION
Heard: May 5, 1983 Decided: July 6, 1983.
When this case was called, no one appeared for the appellee and Counsellor S. B. Dunbar appeared for the appellant and called the Court’s attention to his motion filed to withdraw his appeal. He further informed the Court that a copy of said motion was served on one of counsel for appellee in person of Counsellor Abraham B. Kromah but that up to the hearing date of this case (May 5, 1983) he had not filed his resistance to said motion, even though the Acting Solicitor General, Counsellor A. W. Octavius Obey, was served with the notice of assignment as per the returns of the Marshal. After considering the withdrawal, and there being no resistance thereto, it is hereby adjudged that the motion to withdraw the appeal ought to be and same is hereby granted and the appeal is ordered stricken from the docket of this Court.
The Clerk of this Court is ordered to send a mandate to the lower court commanding the judge presiding therein to resume jurisdiction over the case and enforce its judgment. And it is hereby so ordered.
