Counsel for appellant having made application on the record of this court to withdraw his appeal for his failure to file an approved bill of exceptions, to which application counsel for appellee interposed no objection, it is hereby adjudged:

That the appeal as filed should be, and the same is hereby withdrawn.
The Clerk of this Court is hereby ordered to send a mandate to the court below commanding the judge presiding therein to resume jurisdiction over this case and give effect to this judgment. Costs against appellant. And it is hereby so ordered.
