Tunning appeared for the appellant, and Counsellor Samuel E. H. Pelham appeared for the appellee. Counsel for both parties submitted without argument. In going through the record certified to us, we found a motion to dismiss the appeal filed by the appellee, the grounds of which were that no appeal bond nor notice of completion of appeal had been filed and served. There was no resistance to this motion. It is, therefore, adjudged that the motion to dismiss the appeal be and the same is hereby granted and the appeal is dismissed with costs against the appellant. And the Clerk of this Court is ordered to send a mandate to the court below, commanding the judge therein to resume jurisdiction and enforce the judgment. And it is so ordered. 373
