JUDGMENT WITHOUT OPINION
When this case was called for hearing, Counsellor Stephen B. Dunbar, Jr. of the Dunbar and Dunbar Law Firm appeared for the movant/appellee. Counsellor Molly N. Gray, Sr. of the Jones and Jones Law Firm appeared for the respondent/appellant.
Counsel for respondent/appellant conceded the legal soundness of the motion to dismiss the appeal filed by movant/appellee on the ground that respondent/appellant failed to file an appeal bond and failed to file and serve a notice of completion of appeal in keeping with statute.
The respondent/appellant having not completed the appeal process to confer jurisdiction on this Court to hear this case, it is here by
ADJUDGED:
That the movant’s motion to dismiss the appeal is hereby granted and the appeal is dismissed. The Clerk of this Court is ordered to send a mandate to the judge presiding in the court below to resume jurisdiction over this case and proceed according to law. AND IT IS SO ORDERED.
