RE: SUPREME COURT ORDER # 2

This Court has examined its docket and motions calendar and takes judicial notice that approximately 50% of the appeals and motions listed therein have been pending before this Court since March Term 1985 and also that the counsels of record for the parties have since died and/or their respective law firms, where applicable, no longer exist or have since ceased to function and further, that the address and/or location of the parties are unknown.
Therefore, to remedy this situation, this Court hereby orders the Clerk to establish a dormant docket and motions calendar of the Honourable Supreme Court and therein include all appeals and motions pending before this Court for ten (10) years or more wherein the addresses or locations of the parties are unknown, the whereabouts or address of both adverse counsels of record are unknown or they have since died and/or their respective law firms have ceased to function.
The appeals and motion so herein described shall be placed in the dormant docket, without prejudice, by the Clerk of this Court upon orders of the Court, after the issuance of a notice of assignment and returns thereto made by the marshal stating therein the conditions herein stated above.
Upon motion/application, an appeal or a motion may be ordered returned to the regular docket and/or motions calendar for determination by this Court sitting en banc. And it is hereby so ordered.
