EDWIN GAHIE HODGE, Appellant, v. CHARLES H. D. SIMPSON, Appellee.

JUDGMENT WITHOUT OPINION. Decided February 2, 1973. Appellant, pro se. J. Dossen Richards for appellee. At the call of this case the appellant appeared for himself. Counsellor J. Dossen Richards appeared for the appellee and informed the Court that no notice of completion of appeal had been served and returned as the law required and asked the Court to take judicial notice of the fact. Appellant admitted that he had failed to file a notice of completion of appeal. In view of the circumstances, there is no alternative but to dismiss the appeal. It is, therefore, adjudged that the appeal should be and the same is hereby dismissed. The Clerk of this Court is ordered to send a mandate to the court below informing it of this judgment. Costs are disallowed. 539
