SOLOMON E. HINNEH et. al., Appellants v. REPUBLIC OF LIBERIA, Appellee.

JUDGMENT WITHOUT OPINION

Decided: February4, 1982.

When this case was reached on our docket for argument, Counsellor John A. Dennis appeared for the appellants and Counsellor Jimmie S. Geizue, Solicitor General of Liberia, appeared for the appellee and made the following record, to wit:

“Counselors Jimmie S. Geizue for the Ministry of Justice hereby gives notice to this Honourable the People’s Supreme Tribunal that after carefully reviewing the records in the case and from a close consultation with the Minister of Justice, we are convinced that there is no prima facie case to be made up against the appellants and, therefore, hereby gives further notice that the case be abandoned without further prosecution of said case.

To which no objection was interposed by the appellants. Therefore, it is hereby adjudged. That the notice of abandonment given by counsel for appellee is hereby granted, and the Clerk of this Court is instructed to send a mandate to the court below, ordering it to resume jurisdiction in the case and discharge the appellants from further answering the charge of murder against them. And it is hereby so ordered.

NOTE: His Honour Justice Roosevelt S.T. Bortue participated in the consideration and the decision of this case, but died on the1st of January, 1982, prior to the date of this judgment; hence, he could not sign this judgment.
