Re the estate of S. D. Harvey: This cause having been called for trial Counsellors Barclay and Barclay appeared for appellant and R. Emmons Dixon appeared for appellee; whereupon appellee’s counsel offered a motion to dismiss the appeal because the notice of appeal was not issued in the name of appellee, as the law directs. After argument pro et con, it is adjudged that the judgment of the court below be affirmed, case dismissed. And it is so ordered.
