JUDGMENT WITHOUT OPINION
Decided: February 5, 1982.
At the call of this case for hearing, Counsellor W, K, Neufville appeared for appellant and informed Court that he has filed his brief. The Solicitor General, Jimmie Geizue and Assistant Minister of Legal Affairs, Richard MacFarland, both of the Ministry of Justice, appeared for appellee and notified Court that they have filed a notice of abandonment in this case based upon the fact and law and for good and sufficient reasons. In view of the notice of abandonment filed by appellee’s counsel it therefore adjudged.
That the abandonment as filed by the prosecution is hereby noted and the defendant/appellant is ordered discharged from custody without day and from further answering to this charge.
The Clerk of this Court is instructed to send a mandate to the court below ordering the judge presiding therein to resume jurisdiction and enforce this judgment. And it is so ordered.
NOTE: His Honour Roosevelt S. T. Bortue took part in the hearing and determination of this case but died before final preparation of this judgment. Hence, he did not sign it.
