When this case was called for hearing, Counselors Nyenati Tuan and Jallah A. Barbu appeared for the Movant/Appellee and Counselor David B. Gibson, Jr. of the Wright, Jangaba & Associates Law Firm appeared for the Respondents/Appellants.
Counsel for Respondents/Appellants conceded the legal soundness of the Motion to Dismiss Appeal filed by Movant/Appellee on the ground that Respondents/Appellants failed to file an Appeal Bond and a Notice of Completion of Appeal in keeping with statute.
The Respondents/Appellants having not completed the appeal process to confer jurisdiction on this Court to hear this case, it is hereby ADJUDGED:
That the Movant’s Motion to Dismiss the appeal is hereby granted and the appeal is hereby dismissed. The Clerk of this Court is hereby ordered to send a mandate to the judge presiding in the court below to resume jurisdiction over this case and proceed according to law.
