JUDGMENT WITHOUT OPINION DISMISSING APPEAL. Decided June 13, 1969.* No appearance for appellant. The Simpson law firm, G. P. Conger-Thompson, of counsel, for appellee. At the call of the case for hearing, no one appeared for the appellant, and counsellor G. P. Conger-Thompson, of the Simpson law firm, appeared for the appellee. Counsel for appellee then made an application to Court that in view of the absence of the appellant at the call of this case for hearing, even though duly notified to appear, this Court should, therefore, apply Rule IV, Part 6, of the Revised Rules of this Court. After considering the application, it is hereby ADJUDGED that this case having been regularly assigned, bulletined, and called for hearing and appellant and his counsel having failed to appear, the said application as made by counsel for the appellee is granted and the case dismissed with costs against appellant. And the clerk of this Court is hereby ordered to send a mandate to the court below informing it of this judgment. And it is hereby so ordered.
