JUDGMENT WITHOUT OPINION
Decided: June 14, 1979.
At the call of this case, Counsellor Jacob Nma appeared for the appellants. Counsellor Francis Torpor appeared for the appellees and filed motion to dismiss the appeal on the ground of defective bond, in that the appeal bond approved, filed, and found in the record does not carry a certificate from the Finance Ministry showing that the properties of the sureties are indeed owned by them, the value thereof, nor that they have paid taxes thereon. See Civil Procedure Law, Rev. Code 1: 63.2(4). After studying the record and hearing arguments of counsel on both sides, it is adjudged that the motion to dismiss should be and the same is hereby granted, and the appeal is dismissed with cost against the appellant. The Clerk of this Court is ordered to send a mandate down to the court below commanding the judge presiding therein to resume jurisdiction and give effect to this judgment. And it is so ordered.
