KHALIL FARHAT, Appellant, v. CAREY THOMAS, et al., Appellees.

JUDGMENT WITHOUT OPINION. Decided November 9, 1976.* When this case was called for hearing, Counsellor J. Dossen Richards appeared for appellant, and Counsellor Samuel H. Pelham appeared for appellees and filed a motion to dismiss the appeal on the ground that the bill of exceptions as tendered by appellant, plaintiff below in these proceedings, was not approved by the trial judge. After studying the motion and the appellant’s counsel having conceded the soundness thereof, it is adjudged that the motion should be and the same is hereby granted and the appeal is dismissed with costs against the appellant. The Clerk of this Court is ordered to send a mandate to the court below commanding the judge therein to resume jurisdiction over the cause and enforce the judgment. And it is so ordered. * Mr. Chief Justice Pierre did not participate in this decision. 473
