Counsel for Respondents/Appellants, requested the Court to make a submission, which request was granted. In his submission, Respondents/Appellants’ counsel conceded the legal soundness of the Motion to Dismiss the appeal filed by counsel for Movants/Appellees.
In view of the concession made by counsel for Respondents/Appellants, it is hereby ADJUDGED:
That the Motion to Dismiss the Appeal be and the same is hereby granted. The Clerk of this Court is ordered to send a mandate to the court below to resume jurisdiction and enforce its judgment. Costs against Respondents/Appellants. IT IS SO ORDERED.
