JUDGMENT WITHOUT OPINION

At the call of this case, Counsellor Francis S. Korkpor appeared for plaintiff-in-error and Counsellor Annie Wesley- Swen appeared for defendant-in-error. Counsel for defendant-in-error conceded the pendency of the pre-trial motion before the lower court when trial was proceeded with, and therefore requested this Court to send the case back to the trial court for hearing of said motion. Counsel for plaintiff-in-error having interposed no objection to the submission, it is hereby adjudged that the submission should be, and the same is hereby granted. The Clerk of this Court is hereby ordered to send a mandate to the court below informing the judge presiding therein to resume jurisdiction over the case and to hear the motion to vacate the attachment before proceeding with the trial. Costs are to abide final determination of the case. And it is hereby so ordered.
