When this case was called for hearing, no one appeared for the appellant and Solicitor General Jimmie S. Geizue appeared for the appellee, and by leave of Court gave notice of abandonment for further prosecution of this case. It is therefore adjudged that the notice of abandonment given by the Solicitor General is hereby granted and the case ordered stricken from the docket and the appellant ordered discharged without day and his criminal appearance bond delivered to him.
The Clerk of this Court is hereby ordered to transmit to the court below, a mandate informing it of this judgment. And it is hereby so ordered.
