JUDGMENT WITHOUT OPINION
Heard: June 12, 1986. Decided: August 1, 1986.
When this case was called for argument, the Steele & Steele Law Firm, by and through Counsellor Alfred B. Flomo, appeared for the appellees, and informed the Court that appellees had filed a motion to dismiss the appeal on the grounds that appellant failed and neglected to file an approved appeal bond and notice of completion of the appeal in keeping with law and the statute controlling. No resistance was filed to this motion and even though counsel for appellant acknowledged the service upon him of the notice of assignment from this Court, yet he failed to appear for argument. After studying the motion and the law applicable under the circumstances, it is hereby adjudged that the motion to dismiss the appeal be, and the same is hereby granted with costs against the appellant.
The Clerk of this Court is hereby ordered to send a mandate to the court below to resume jurisdiction over the case and enforce its judgement. And it is hereby so ordered.
