ACTION OF DAMAGES FOR BREACH OF CONTRACT
JUDGMENT WITHOUT OPINION
While the appeal announced in this case was pending before this Court undetermined, the parties informed the Court that they had jointly executed an agreement of voluntary discontinuance and filed it with the Clerk of Court.
That they stipulated in the agreement of voluntary discontinuance that in consideration of the amount of US$50,000.00 (Fifty Thousand United States Dollars) paid by the appellant/defendant to the appellee/plaintiff by check No. 00029203, dated February 5 2015, drawn on UBA Bank, the receipt of which was acknowledged by plaintiff/ appellee. The appellant/defendant should withdraw its appeal announced from the final judgment rendered on January 16, 2015, by the Ninth Judicial Circuit Court of Bong County. The parties signed the agreement of voluntary discontinuance which was approved by Mr. Chief Justice Francis S. Korkpor, Sr. in keeping with the Revised Rules of the Supreme Court.
WHEREFORE, and in view of the foregoing, it is hereby
ADJUDGED:
That the Court having considered the submission made by the parties, perused the agreement for voluntary discontinuance and being satisfied that the voluntary discontinuance is in conformity with the Revised Rules of the Supreme Court, hereby grants the submission requesting for voluntary discontinuance. Accordingly, the appeal is discontinued and ordered dismissed.
The Clerk of this Court is ordered to send a mandate to the judge presiding in the court below to resume jurisdiction over this case and give effect to this judgment. Costs are ruled against the appellants/defendants. It is so ordered.
