Counsel for Defendants-In-Error having conceded the legal soundness of Plaintiffs-In(‘ Error’s contention on the sole point of non-service of the Writ of Summons, it is hereby ADJUDGED:
That the Writ of Error be and the same is hereby granted. The Clerk of this Court is hereby ordered to send a mandate to, the Civil Law Court, Sixth Judicial Circuit, commanding the Judge presiding therein to resume jurisdiction and commence the trial anew. Costs to abide final determination. AND IT IS HEREBY SO ORDERED.
