Perry appeared for the defendants in error. Counsellor Stephen Dunbar appeared for the plaintiff in error and filed a notice of withdrawal of the appeal taken from the ruling of the Justice in chambers, based upon stipulations signed by the parties. In view thereof, it is hereby adjudged that the ruling of the Justice should be and the same is affirmed with costs against the plaintiff in error. And the Clerk of this Court is ordered to send a mandate to the trial court, commanding the judge presiding therein to resume jurisdiction over the case out of which these proceedings have grown, and enforce the judgment. And it is so ordered. Mr. Justice Henries, who presided over proceedings in chambers, did not participate in this decision. 570
