JUDGMENT WITHOUT OPINION Decided: February 28, 2005.

At the call of this case, Counsellor Yamie Q. Gbeisay of the Tiala Law Associates appeared for the appellant and Counsellor Theophilus C. Gould, Solicitor General of the Republic of Liberia, appeared for appellee.

Counsel for appellee requested to make a submission which was granted. In hissubmission, the appellee’s counsel brought to the attention of the Court that following the review of the case file and the facts as it now stand, he has affixed his signature to the notice of withdrawal of the cause of action which has been duly filed consistent with law. Counsel for appellant says that as evidenced by his signature on the notice of withdrawal, he interposes no objection.

This Court, having ascertained from both parties whether their clients acquiesced to the notice of voluntary discontinuance and withdrawal of appeal, it is hereby adjudged that the submission made be, and same is hereby granted. The appeal is withdrawn and the matters discontinued.

The Clerk of this Court is hereby ordered to have this case stricken from the docket of this Court. Costs are disallowed. And it is hereby so ordered.

NOTE: Associate Justice Korkpor, Sr., having served as counsel for one of the parties in the court below, recused himself; hence, he did not sign this judgment.
